Department Of Justice
As per the 1961 rules of Government of India (Allocation of Business), different departments were formed under the Law and Justice Ministry of the Government of India. It was as per these rules, the Ministry is supposed to have the departments as below.
- Department of Legal Affairs
- Legislative department
- Department of Justice
Department of Justice caters to the following functions:
- Work related to the appointing of Chief Justice of India, various other judges of Supreme Court and different High Courts in the country, as well as their removal and matters relating to resignation are dealt. Also, matters regarding salaries and perks, leave of absence and allowances rights, allowances for travelling and pensions are to be looked.
- Supreme Court formation and its organisation, not including the powers and jurisdiction and the fees related to different matters, including the court contempt matters
- High Court organisations and constitutions and the judicial commissioners appointments, excluding the appointment of servants and officers to these respective courts
- Organisation and constitution of the UT courts and deciding the fees levied in these
- Managing the funds allocated through awards by finance commission
- Compiling after collecting data on the cases which are instituted or disposed or pending in courts and checking various prisoners under trial
- Reforms related to judiciary are initiated
- Operating and setting up of National Mission for the purpose of delivering justice and reforms related to legal matters
- All India Judicial Service is created
- Scheme implementation in order to facilitate the modernisation and development of judicial infrastructure
- Department of justice is strengthened with measures like e-office, statistical strengthening, improvising the website which is official and providing training to personnel and augmenting the resources.
The organisational set up of the Department of Justice is such that at the top most position is the Union Cabinet Minister in charge of Law and Justice. Presently Shri Ashwani Kumar is the Minister of Law and Justice. Helping out in the affairs of the ministry are few personal assistants and secretaries to the minister and various bureaucrats from civil service categories, starting from the level of secretary Justice to Joint Secretary.
Acts and Rules
There are various Acts & Rules of the central government related to Constitution of India, Contempt of Court, Court Fee Act, Judges Protection Act, Judges Enquiry Act, Salaries rules, and few others. It is the function of the Department of Justice to work on these acts and rules and regulate their proper implementation.
Appointment of Judges to the Supreme Court, High Courts in the states, Union Territories and the vacancy positions are to be regulated.
Another important aspect of the duties of the Department of Justice is to monitor the Thirteenth Finance Commission Grants and proper utilisation of the allocated amounts at the state and gram nyayalaya levels. Apart from this, annual reports of the Law Commission, circulars on service conditions of the judges, Report of the Task Force on Judicial Impact Assessment and guidelines of the gram nyayalayas are to be formulated.
